Brazilian Supreme Court removes ICMS presumed credits from PIS and Cofins

Brazil's Supreme Court ruled, with binding effect, that ICMS presumed credits cannot be included in the PIS and Cofins tax base. The benefit is not revenue. The Court has not yet decided whether the ruling applies to past periods.

STF exclui crédito presumido de ICMS da base do PIS e da Cofins

A decision rendered under the general repercussion regime excludes the presumed ICMS credit from the basis of the contributions, but leaves the modulation of effects undefined.

What has changed with the decision on the presumed ICMS credit

On 07/10/2026, the Supremo Tribunal Federal (STF, Brazil’s Federal Supreme Court) concluded its judgment on the presumed ICMS credit (ICMS being the Brazilian state tax on the circulation of goods and on certain services). The Court established a binding thesis under the general repercussion regime. According to that thesis, it is unconstitutional to include this benefit in the calculation basis of PIS and Cofins (federal social contributions levied on revenue).

In practical terms, the Court dismissed the appeal filed by the Federal Union. Accordingly, the understanding favourable to taxpayers now guides all other courts in the country. In addition, the thesis is binding on the federal tax authorities in similar cases.

The central issue is the concept of revenue. In the view of the STF, the presumed ICMS credit represents neither new wealth nor an increase in net worth. In other words, it is an incentive granted by the State, and not company turnover.

The Federal Union argued for a different reading. In its view, the basis of the contributions corresponds to the totality of revenues since Constitutional Amendment 20/1998 and Laws 10.637/2002 and 10.833/2003. For that reason, only the exclusions expressly provided for by statute would be admissible. The Court, however, rejected that argument.

Furthermore, the Court held that the accounting treatment does not alter the nature of the benefit. Therefore, recording the presumed credit as revenue in the books does not turn it into taxable revenue.

Who may be interested in the ICMS tax benefit

The decision is of interest to all companies that receive presumed ICMS credits from the States. Such incentives are common in industry, agribusiness, wholesale trade and logistics. They also appear frequently in state programmes designed to attract investment.

The thesis likewise reaches taxpayers already litigating the matter in court. Those proceedings must follow the established understanding, with effects on pending actions and on offset claims.

On the other hand, the decision addresses only the presumed credit. Other ICMS benefits, such as reduction of the calculation basis, exemption or deferral, were not the subject of the judgment. Accordingly, extending the thesis to those incentives will still require specific analysis.

Likewise, companies that have never paid PIS and Cofins on the benefit should pay attention. For them, the decision reduces the risk of assessment, but does not put an end to disputes regarding earlier periods.

What still awaits definition regarding the presumed ICMS credit

The main outstanding point is the modulation of effects. The Justices did not examine whether the thesis will apply only prospectively or also retroactively. The matter may still be raised by way of motion for clarification (embargos de declaração).

In the meantime, caution is advisable in relation to claims for recovery of amounts. Any modulation may limit refunds to those who had already filed suit by a given date.

There is also no news as to the date of publication of the judgment or as to regulation by the Receita Federal (Brazilian Federal Revenue Service). In addition, the decision did not address the effects of the presumed credit on IRPJ (corporate income tax) and CSLL (social contribution on net profits).

In short, the thesis is favourable to taxpayers, but its temporal scope has not yet been defined. Each company must assess its own situation on the basis of its own tax and accounting records.
