Portugal · Family and Succession Law
Family and Succession Law between Brazil and Portugal
Divorce, children, maintenance and inheritance when life is divided between the two countries. We handle the case in both jurisdictions, with lawyers in Brazil and in Portugal.
An initial 30-minute video consultation. We reply within 1 business day.

Situations we handle
In all of them, a decision taken in one country must be effective in the other. That is what we coordinate.
01
Divorce and separation
Brazilian couples living in Portugal, or mixed-nationality couples, who need to decide where to file for divorce, how to divide assets in both countries and how to make the decision effective on both sides.
02
Children: custody, contact and relocation abroad
When one parent returns to Brazil or moves to Portugal with the children: custody, long-distance contact arrangements, travel authorisation and the Hague Convention on the removal of children from one country to another.
03
Cross-border maintenance
Establishing, reviewing or enforcing maintenance payments when the payer and the recipient are in different countries, using the cooperation mechanisms between Brazil and Portugal.
04
Probate and inheritance
Death with assets or heirs in both countries: probate proceedings in Brazil for those living in Portugal, establishment of heirs’ entitlement (habilitação de herdeiros) in Portugal for those living in Brazil, and representation of those unable to attend in person.
05
Recognition of judgments
Recognition before the STJ (Brazil’s Superior Court of Justice) of divorces and judgments issued in Portugal, and recognition in Portugal of Brazilian decisions, so that they take effect in both countries.
06
Succession planning
Wills, gifts and the organisation of assets for families with property in Brazil and in Portugal, in order to avoid two conflicting probate proceedings.
How it works
- You describe your case in the form on this page. It takes five minutes and is treated in strict confidence.
- Within 1 business day, we reply by e-mail with a link to schedule the initial consultation: 30 minutes by video call, with the lawyer who will handle the case.
- After the consultation, you receive in writing the recommended course of action, with the stages involved, estimated timeframes and a fee proposal. Only then do you decide whether to engage us.
If the case is not one for us, we will say so during the consultation and refer you to someone who can help.

Frequently asked questions
Is there a charge for the initial consultation?
The initial 30-minute consultation serves for us to understand the case and tell you whether we can help. Fees are presented in writing afterwards, and only then do you decide.
Do I need to travel to Brazil or to Portugal to resolve the matter?
In most cases, no. With a power of attorney, we represent you in the country where you are not present, and meetings are held by video call.
There are already proceedings under way. Will you take the case on?
We review what has already been done and, depending on how the proceedings stand, we may take the case on at whatever stage it has reached, in Brazil, in Portugal or in both.
I live in another country, neither in Brazil nor in Portugal. Do you assist?
Yes, provided the case has a connection with Brazil or with Portugal: assets, heirs, children or proceedings in one of those countries.
In which languages do you provide assistance?
Portuguese, English, Spanish, Italian and French.
